§ XI. [Commercial uses.]

A.

All commercial uses proposed to be established at a location within 300 feet of a residential use shall be considered a commercial use and shall not be so established without first obtaining a conditional use permit.

B.

A conditional use permit is not available and may not be granted for a bar or tavern that is proposed to be established within 300 feet of a residential use.

C.

Except for one-day or weekend-long "special events", no live entertainment shall be held or established within 300 feet of a residential use and no conditional use permit may be granted for such a use.

D.

Existing commercial uses or establishments that are not in compliance with the regulations set forth in this section shall be deemed to be abandoned after 90 days of non-use and shall not be re-established except in compliance with this ordinance.
